ATTENDANCE
Regular attendance is expected and necessary for tutoring to benefit any student. Students with excessive absences can lose their designated time if Mind Over Math deems necessary.

CANCELLATION POLICY
The Student may cancel tuition by giving at least 24 hours prior notice to Mind Over Math in which case no tuition fees will be incurred. Lessons not attended by the student without giving 24 hours prior notice to the Tutor shall be charged at the full rate.

Mind Over Math may cancel lessons by giving prior notice to the Student in which case no fees shall be incurred. Where a lesson was pre-paid, Mind Over Math shall reschedule the appointment at a time agreeable to both parties.

MEDICAL INFORMATION
If your student has any pertinent medical information, please specify in the box marked "Additional Information" below. Please include any allergies, medications and special needs. This information will be kept confidential and will only be accessed by staff on a need-to-know basis.

PAYMENT
Fees shall be calculated at the hourly rate stated in the introductory email for your Student. A 5% discount will be applied to one-on-one tutoring sessions when the student is tutored in two or more subject areas concurrently or when paying by cash or check. Late payment will invalidate the discount on overdue invoices. Payment must be made by the invoice due date or Mind Over Math reserves the right to apply a late fee of 5% (per month) and suspend tutoring.

No further fees shall be charged for traveling or preparation time of the Tutor. If a placement test is requested for subject tutoring there will be an additional fee of ($100) one-hundred dollars. Fees may be adjusted from time to time and shall become effective after giving the Parent written notice.

LATE ARRIVAL
Fees are calculated according to the times stipulated in the schedule and no adjustment shall be made for time lost because of late arrival by the Student. Any lost time because of the late arrival of the Tutor shall be compensated by extending a lesson by mutual agreement and by such amount of time that was lost.

OBLIGATIONS OF THE TUTOR AND MIND OVER MATH
* The Tutor undertakes to do all preparation prior to lessons and to structure lessons in such a way as to optimize time to the benefit of the Student.
* Mind Over Math shall keep confidential all information of the Student and shall contact other parties involved in the education of the Student only if given written permission by the Student to do so.
* The Tutor shall at no time be required or obliged to execute homework or assignments on behalf of the Student.

OBLIGATIONS OF THE STUDENT
* The Student undertakes to assist the Tutor in identifying problem areas in which the Student needs specific tutoring.
* The Student agrees that assignments, exercises or homework form an integral part of tutoring and undertakes to complete such work in a timely manner.

NO SOLICITATION
Parent or Student shall not, during the term of this Agreement and for a period of one (1) year immediately following the termination of this Agreement, or any extension of it, for any reason, either directly or indirectly, solicit or attempt to solicit the services of any Tutor(s) provided by Mind Over Math for their personal use or for any other person or entity with which Parent or Student has an association. Failure to comply with this policy will result in termination of all services, and depending on the severity of the offense, legal action.

NO WARRANTIES
Neither Mind Over Math or the Tutor make promises or warranties with regards to the Student's performance as a result of any tutoring provided.

MINORS
Where the Student is a legal minor, the Parent/Guardian shall enter into this tutoring contract on behalf of the Student and shall accept and agree to all the terms and conditions contained herein on behalf of the Student.

TERMINATION
Tutoring may be terminated independently by either party at any time by giving the other party (7) seven days prior written notice.

RELEASE OF LIABILITY
With acceptance to attend Mind Over Math, I hereby release Mind Over Math Tutoring and all personnel, partners and sponsors connected with Mind Over Math or the programs it sponsors from any liability, illness or property damage that I sustain during my participation in this program or that is in any way related to this program. I understand that this applies to myself, my child and our respective successors and personal representatives. I hereby authorize the directors and staff of Mind Over Math Tutoring to provide or retain medical care and to obtain emergency medical attention. I accept responsibility for the payment of any medical treatment which may be required. My child is physically fit to participate in program activities according to our family physician.

RELAXATION OF TERMS
No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.

WHOLE AGREEMENT
This agreement constitutes the entire understanding between the parties with regard to the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein. Any alteration to this agreement must be in writing and signed by both parties.
